Industry Rate of Duty Drawback to be announced soon: Member (Customs)

FIEO
organized an interactive session with Mr J.K. Batra, Member (Customs),
Central Board of Excise & Customs (CBEC) in New Delhi on 29th July. A
large number of exporters, shippers, freight forwarders, representatives
from EPCs, Chambers of Commerce, Trade Associations, etc. participated in
the session.
Welcoming the
participants, Dr. R K Dhawan, Chairman, FIEO (Northern Region) complimented
the Department for introducing Core Banking System saying this would
automatically credit duty drawback to exporter’s core-banking account
under EDI.
Dr. Dhawan
sought better coordination between Department of Commerce and Department of
Revenue and suggested that all corresponding notifications should be issued
simultaneously, as and when any scheme was announced, so that the exporters
did not keep waiting for availing a scheme.
In his
address, Mr. Batra advised exporters not to hesitate in contacting higher
authorities as and when they faced problems with field formations of Customs
and also advised them to take up their issues in redressal committees of
each customs house. These committees are known differently as Public
Grievance Committee or Watchdog Committee or Trade Facilitation Committee.
All these committees in each customs house meet at regular intervals to sort
out the issues of the trade, Mr. Batra, informed.
Commenting on
Dr. Dhawan’s remark seeking better coordination between Department of
Commerce and Department of Revenue, Mr. Batra pointed out that there were
differences of opinion between various departments but there was also a
mechanism to sort out the issues. He informed that there was a committee
looking into All Industry Rates of Duty Drawback for exporters and the
Government would announce the new rates soon.

Earlier,
while initiating the discussion, FIEO Director General Mr. Ajay Sahai
brought to the notice of Mr. Batra the problems faced by exporters in
taking refund of service tax. He requested for a clarification from
Drawback Directorate that the output services on which service tax was
to be refunded had not been factored into the calculation of drawback
rates so that Service Tax Directorate could be approached for
amendment in Service Tax Notification.
During
open interaction with the audience, on the issue that Customs
Notification No. 64/2008-Cus. dated 9.5.2008 requires amendment in
consonance with Foreign Trade Policy |

applicable
from 1.4.2008 with regard to benefits under EPCG Scheme, Member (Customs)
informed that this issue was under examination.
For allowing
re-export of defective/unfit goods imported under all the promotional
schemes, Member (Customs) informed that amendment in Customs Circular No.
75/2000 dated 11.9.2000 was being considered.
On FMS Scrips
not being verified by Customs authorities at Mulund and Mumbai Airport,
Member (Customs) informed that almost all cases had been registered and if
any specific case was not registered so far, then it may be brought to his
notice.
Regarding
refund of excess duty of 2% paid on clearance of imported capital goods
under EPCG due to late issuance of Customs Notification, Member (Customs)
clarified that there was no such provision in Customs Act.
Responding to
a request that duty free import of "Printed Bags" should also be
extended to exporters of textile made-ups, Member (Customs) said that only
on the recommendation of the Textiles Ministry supported by Department of
Commerce, it had been excluded. Meanwhile, he assured to look into the
request.
On the issue
that Customs impose duty on re-importation of replacement capital goods
under EPCG Scheme, Member (Customs) advised exporters to follow Drawback
route while re-exporting Capital Goods on replacement basis.
Regarding
Central Excise rebate against duty paid on exports under DFIA Scheme, Member
(Customs) informed that the issue was under examination and a final decision
would come out in three to four weeks’ time. Similarly, a decision would
also be taken soon on the issue of refund of unutilized CENVAT Credit for
Service Tax paid on input services, he added.

On
the issue that Varanasi ICD Customs authorities are denying Drawback
to exporters of 100% Natural Silk Fabric with embroidery under Tariff
Head 500701, Member (Customs) asked Joint Secretary (Drawback) present
in the meeting clarify the matter with Varanasi Customs.
With
regard to delay in release of duty drawback, Member (Customs) advised
exporters to take up the matter in the Public Grievance Committee
meetings in each Customs House, chaired by Commissioner of Customs. |

Regarding
refund of service tax on services linked to exports made under duty
drawback, Member (Customs) informed that the matter was being examined.
Member
(Customs) was accompanied by Mr. Najib Shah, Joint Secretary (Drawback), Mr.
C.P. Srivastava, Commissioner of Customs, ICD, Tughlakabad, Mr. John Joseph,
Commissioner of Customs, IGI Airport Customs, New Delhi and other senior
officers from CBEC looking after customs, central excise and service tax
matters.
